Welcome to XDERA Network ("XDERA", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at xdera.net, our Android mobile application named Alize (Advanced Virtual AI Assistant), our TTS API, and any related services (collectively, the "Service").
2. Eligibility
You must be at least 16 years of age to access or use our Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 16, you are strictly prohibited from using the Service.
3. Description of Service
The Service consists of:
- XDERA Network (xdera.net): Our official website for information, documentation, and downloading the Alize app.
- Alize App: An AI assistant for Android featuring voice alarms, chat-based reminders, internet browsing capabilities, Text-to-Speech (TTS) voiceovers, and daily affirmations ("Mantras").
- TTS API: An exclusive, invite-only Application Programming Interface providing access to our Text-to-Speech generation.
4. User Accounts and Authentication
To use the Alize app, you must authenticate using your Google Account. You are solely responsible for maintaining the security of your account. Access to the TTS API requires a specific API key granted directly by us. We reserve the right to revoke API access at any time, with or without cause.
5. Artificial Intelligence and Feature Disclaimers
Given the experimental and automated nature of AI, you acknowledge and agree that:
- Accuracy & Availability: AI-generated responses and internet browsing features may be inaccurate, incomplete, or temporarily unavailable. You should not rely on the AI for factual accuracy.
- Alarms & Reminders: The alarm and reminder features in Alize are provided for convenience only. We do not guarantee that alarms or reminders will trigger at the exact time requested. You agree not to rely solely on Alize for critical events. We are not liable for any consequences resulting from missed alarms or reminders.
- Mantras & Affirmations: The affirmation features are for entertainment and general well-being purposes only. They do not constitute professional medical or psychological advice.
6. Acceptable Use Policy (AUP)
You agree NOT to use the Service to:
- Generate, promote, or distribute illegal content, malware, or fraudulent schemes.
- Generate hate speech, harassment, or discriminatory content.
- Use the TTS feature to impersonate real individuals, create malicious "deepfakes", or deceive others.
- Attempt to reverse engineer, hack, or disrupt the Service or the xdera.net website.
7. Intellectual Property and Content Usage
Platform Rights: We retain all rights, title, and interest in and to XDERA, Alize, the TTS API, and all associated underlying technology.
Output Restrictions and Licensing: The usage rights for audio generated by our Text-to-Speech (TTS) technology differ based on the source:
- TTS API (Invite-Only): Any audio generated using the TTS API is strictly for Personal, Non-Commercial Use. You may not monetize, sell, distribute for profit, or use this audio in any commercial projects.
- Alize App (In-App TTS): Audio generated directly within the Alize application may be used for personal projects and independent content monetization (e.g., individual YouTube channels, social media content). However, you are strictly prohibited from using the in-app TTS audio for large-scale corporate purposes, enterprise broadcasting, or any projects involving formal commercial contracts with large corporations or third-party businesses without our explicit written permission.
8. Payments, Subscriptions, and Refunds
Freemium Model: The Service is offered on a freemium basis. Advanced features may require a premium subscription or the purchase of virtual credits.
Payment Processors: Payments are processed through third-party gateways (e.g., PayPal) or via direct manual transfer arrangements. We do not store your financial information.
Refund Policy: All purchases are final and non-refundable. Exceptions for refunds will only be considered and granted at our sole discretion if there is clear, proven evidence of a system error, bug, or defect directly caused by our platform.
9. Termination and Account Suspension
We reserve the right to suspend, block, or terminate your access to the Service, Alize app, and revoke any TTS API keys immediately, at our sole discretion, and without prior notice, if we determine that you have violated these Terms.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. XDERA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, BUG-FREE, OR COMPLETELY SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL XDERA, ITS CREATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Dispute Resolution and Governing Law
If we have a dispute, we prefer to resolve it through amicable negotiation first. You agree to contact us to attempt to resolve any issues informally. However, if formal legal action becomes necessary, these Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any formal disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this document. Continued use of the Service constitutes acceptance of the modified Terms.
